By using Nivora (the "App"), you acknowledge and agree to the following:
You understand and acknowledge that being on the mountains or engaging in activities related to mountainous terrain involves inherent dangers, including, but not limited to, the risk of injury or death due to natural hazards such as avalanches. You voluntarily assume all risks associated with using the App and participating in mountain-related activities.
You are responsible for your own safety and the safety of others while using the App and being in mountainous environments. You agree to exercise caution, make informed decisions, and follow all safety guidelines and instructions provided by the App to ensure the well-being of yourself and others.
The App provides information and tools for avalanche risk management, but it does not guarantee the accuracy, completeness, or reliability of the information. The App may rely on third-party data sources and may not always reflect real-time conditions or hazards. You agree to use the App at your own discretion and acknowledge that the App does not provide absolute protection against avalanches.
To the fullest extent permitted by law, you hereby release and discharge Nivora, its officers, employees, contractors, and affiliates from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with your use of the App and participation in avalanche activities.
You agree to indemnify and hold harmless Nivora, its officers, employees, contractors, and affiliates from any claims, actions, damages, liabilities, or losses arising from your use of the App and being in mountainous environments or participating in activities related to mountainous terrain.
This General Release of Liability shall be governed by and construed in accordance with the laws of Milano, Italy. Any disputes arising out of or related to this release shall be subject to the exclusive jurisdiction of the courts of Milano, Italy.
By using the App, you acknowledge that you have read, understood, and agreed to this General Release of Liability. If you do not agree with any part of this release, you should refrain from using the App.
